Kevin explains that DV is not a standalone crime, but a sentence enhancer applied when any criminal act against a person, property, or even an animals used to intimidate, punish, or control an intimate partner. Many people are surprised by how broad the definition is, covering everything from assault to harassment, vandalism, or even alarming text messages. Kevin also outlines Colorado’s mandatory arrest policy, meaning that when police respond to a DV call and find probable cause, someone must be arrested. This often shocks families, as even heated arguments can lead to jail time. Within the first 24–48 hours, defendants face immediate consequences, including a mandatory protection order that may bar contact, require them to leave the shared home, and force firearms surrender. Violating the order—intentionally or accidentally is a new criminal offense. The discussion also covers false or exaggerated allegations, especially during divorces or custody disputes. Once the system is triggered, cases can be difficult to unwind, making early legal representation essential. A DV conviction carries long-lasting effects: mandatory treatment classes, firearm restrictions, and a criminal record that cannot be sealed. Kevin stresses that after a DV arrest, individuals should avoid contacting the alleged victim and seek experienced legal counsel immediately.
