However, Carolyn explains that a will does not avoid probate. Instead, a will provides instructions to the court about how a person’s assets should be handled and who should be responsible for managing the estate. The probate process typically begins when the will is filed with the probate court. The court then formally recognizes the person named in the will as the personal representative, sometimes called the executor. This individual is responsible for managing the estate’s affairs. Their duties include identifying and gathering assets, notifying creditors, paying outstanding debts and taxes, and eventually distributing the remaining assets according to the instructions in the will. Even when everything goes smoothly, probate can take several months and sometimes longer depending on the complexity of the estate or if disputes arise among heirs. Carolyn emphasizes that while having a will is far better than having no plan at all, it may not be the most efficient option for every family.
